Web Hosting Terms of Service

The following is North Texas Web Design’s Terms of Service for Web Hosting on our Private/Dedicated Servers.

While it’s never a requirement that customers host with us, North Texas Web Design offers web hosting ONLY to customers we build websites for. We offer this hosting on dedicated, private servers. located in hardened data centers We do NOT offer general shared web hosting to anybody else. This hosting policy ensures we “control” the products and websites on our servers, thus providing a much better hosting environment to our clients than generally provided by general shared hosting providers.

North Texas Web Design reserves the right to terminate an account at any time without a refund. Reasons for termination include (but are not limited to):

1. Abuse of the machines – either intentional or due to improper coding
2. Committing or Promoting any type of illegal activity including fraud, mailbombing, denial of service attacks, storing and/or housing and/or linking to illegal content, including but not limited to, “warez”, “hacking”/”cracking”/”key generators”.
3. The Services to traffic in illegal drugs and/or obscene materials.
4. The Services to misappropriate or infringe the patents, copyrights, trademarks or other intellectual property rights of any third party.
5. Additionally, North Texas Web Design reserves the right to terminate your account if at any time your site has pornography and/or nudity of any kind, including but not limited to, adult pornography, Anime, child pornography, “adult content” and/or the written word of a sexual nature.
6. If a third party is granted access to your site on our server and or domain name, and makes adjustments, changes, or additions – any issues that arise from that will not be our responsibility.  All time to fix or undo their work will result in an hourly charge at $101.  While we encourage our clients to work on their own sites we also reserve the right to protect our interests.  Third-party access can and may result in hosting termination with no refund on the remaining time.  You will be given 30 days to move your site to another hosting provider.  If you require us to zip up your files, please let us know.  This includes but is not limited to: WordPress Dashboard, Google Site kit, SEO Dashboard, CPANEL, EMAIL, or DOMAIN access.
7. Use of ad-servers, attempts to circumvent quota system owned by ‘nobody’, certain podcasting or video sites, use of torrent software, proxies, excessive resource usage or ‘core dumping’.
8. Attempts to circumvent any of our security policies, procedures, or systems.
9. Excessively rude or abusive language and/or unprofessional behavior towards any employee or contractor of North Texas Web Design.
10. All billing will be done on March 1st of each year.  Invoices are due no later than March 7th. We no longer accept checks.  We only accept Debit/Credit cards through our Stripe Portal.  If there is a reason you cannot pay via Credit Card we may be able to accommodate, please contact us to let us know. Cancelation Policy

To initiate the cancellation of your hosting services, please reach out to us via phone or email. Kindly provide a notice period of at least 30 days for annual hosting accounts and a minimum of 7 days for monthly accounts. Failure to initiate cancellation will result in the continuation of site maintenance and billing.

Upon receiving your cancellation request, any outstanding service charges will be billed. Once these charges are settled, your account will be terminated. Following termination, we will furnish you with the necessary files and database for your website should you wish to host it elsewhere.

If you require our assistance in migrating your website, a one-time fee of $299 will apply. Alternatively, if another company is handling the migration, kindly instruct them to contact us at [email protected].
